Design Project Terms and Contract

All services provided by Digital Snack Bar are subject to the following terms and conditions. The terms and conditions listed below (last modified November 1, 2023) are designed to protect the rights of my clients, while at the same time protect me (the designer/developer) and my work. If you do not agree with any term(s) listed below, please do not contact me. Hiring me to design your project constitutes your agreement to all such terms, conditions and notices. Please read them carefully. By hiring me, you agree to these terms without limitation or qualification.

Payment/Deposit Conditions
The following applies to all FIRST TIME clients…
+ For all work $500 and under, full payment must be received before the start of any work.
+ For all work over $500, a 50% non-refundable deposit fee must be received before the start of any work. All deposits secure the start of your project and guarantee my acceptance of it.

The following applies to all EXISTING clients…
+ For all work $250 and under, full payment must be received before the start of any work.
+ For all work over $250, a 50% non-refundable deposit fee must be received before the start of any work. All deposits secure the start of your project and guarantee my acceptance of it.

+ Once the basic design is developed and approved (by you the client), the remaining balance is due. In all cases, completion of the design will be put on hold (no image upload or materials delivery) until the balance due is paid in full.*

Project Details
+ It is important that you are crystal clear with your needs, so that you are quoted accurately and your needs are met as accurately as possible. All written and visual content to be applied to your page must be provided. Please be as detailed as you possibly can. This is very important to ensure your product satisfaction.

Inconvenience Fees
+ Inconvenience fees may apply to orders that require unreasonable, continuous and repetitive revisions or requests that inconvenience the designer and/or business and/or interfere with the regular flow of business.

Project Turnaround Times and Deadlines
+ Please keep in mind that I cannot start any project without having all the needed materials (ie: photos, content text, etc.) The sooner you provide me with all needed content/pictures/details etc. necessary to get started and complete your project, the sooner you will receive your project. I work as fast as you do. If you have a preferred color scheme and/or any ideas about how you envision your design to look, please tell me before the start of your project so I can design accordingly and efficiently.

+ Stand-Alone Services (ie; Website Maintenance, Script/Plugin Installation & Setup, Social Media page graphics (FB Timeline Cover Photos, etc.), Graphic Design) are usually completed within 48-72 hours.
+ Smaller web projects (ie; Splash & Landing pages & Micro sites) are usually completed within 1 – 1 ½ weeks.
+ Medium sized web projects (ie; Basic Starter & Standard websites) are usually completed within 2-3 weeks.
+ Larger web projects (ie; Ecommerce) are usually completed within 6-8 weeks.

However, these turn around times can vary greatly and depends on how many other projects are ahead of yours and what my current design schedule is. It also depends on the complexity of the project. I will give you an approximate turn around time at the time of project confirmation and before any payment or deposit is received. I will work hard to meet your estimated deadline. However, I do not guarantee deadlines as each project is unique and so is each client. I will communicate with you during the entire development of your project and provide you with status updates. Please understand that additional services, revisions to design or development of your project and delays in providing me with the information I require will significantly add to the delivery time.

Client Communication
+ Communication is absolutely crucial and important in the speed of delivery of your project. As far as communication with my clients go, all communication is required through email. I like for both myself and the client to have copies of all correspondences to refer to at later stages. Email is perfect for this. It avoids confusion over the finer details of contracts, design ideas, and so on. You are encouraged to email me as often as you need to. Telephone communication is ONLY available if absolutely necessary and/or in certain situations/circumstances (at my discretion). Please understand that I am an extremely busy web designer with many other clients and design projects going on, so telephone contact as a constant communication method does not work well for me time-wise and hinders my efficiency.

After three months of no communication from a client, the project will be archived. To resume and complete the project, there will be a restart fee of $50.00. I also reserve the right to resell the designs to recover services rendered.

Payment Late Charges and/or Failure To Pay
+ For cases where full payment was not due before start of project but only a 50% deposit: Once the design is complete (and approved by you) you will have 72 hours to pay the balance in full. If payment is not made within 72 hours then a $25 late fee will be added to the total balance due. You will be notified via email once the 72 hours have expired and the $25 late fee is imposed. 10 calendar days after the late fee is imposed if the full balance due still have not been received then you will have forfeited the deposit you paid and will have to place a total new order OR pay a 20% interest fee (of TOTAL project cost) that will be applied to any and/or all individual projects every 30 days of non-payment.

If you need more time to pay the final balance due to an unforeseen occurrence, for example, personal crisis, illness, family emergency, death, etc. please let me know so that I can work with you.

+ If a new order is placed, then full payment must be made in advance even if the total order is more than $500. If you are opting to pay the 20% interest payment then that will need to be paid in full in advance before any work commences again.

Digital Snack Bar reserves the right to withhold any and all works until 100% of invoice is paid in full. Failure to pay will result in complete loss of work (such as maintenance) performed after any initial invoice. Digital Snack Bar has the right to pursue legal action in an attempt to collect outstanding debts. Unprofessional and unethical conduct (including harassment, profanity, discrimination, threats of any kind, slander and any other unethical behavior) can and will result in complete forfeit of project. Failure to comply with each term of service can result in pursuance of legal action, as email correspondence is a legally binding contract.

Refund Policy
+ All deposits/payments are non-refundable. In the event of major unforeseen occurrences, for example, personal crisis, illness, family emergency, death, etc. refunds will be considered on a case-by-case basis and at my sole discretion. Should you request a refund after I have already started on your project (or a project is canceled or postponed) all monies paid are retained by Digital Snack Bar and if applicable, a fee for all work completed beyond what was already paid for shall be paid by the client. Any refunds issued at my sole discretion will be issued within 30 days of the decided date of project termination. In the event of project termination, ownership of all artwork, layouts and development remains the property of Digital Snack Bar and will not be transferred to the client.

30 Day Refund Policy
+ Digital Snack Bar will issue a complete refund of any amount tendered if held accountable for delay of completed project after 30 days of initial payment and I am completely unreachable. Such delays could be a result of, for example, personal crisis, illness, family emergency, death, etc. Client will be notified immediately of such delay beforehand if possible. This 30 Day Refund policy only applies if I am indeed held accountable and/or I decide that I am unable to work with a client due to personal, ethical or other reasons. If client is causing delay of project and/or has displayed unprofessional and unethical conduct (including harassment, profanity, discrimination, threats of any kind, slander and any other unethical behavior) and I cannot continue working with them, this policy will not apply, and no refund will be issued. (Please refer to REFUND POLICY directly above)

Rush Fees
+ If you need a project completed that will require me to put all other projects on hold, a RUSH FEE will be applied. This will be quoted to you individually. Rush fees vary upon the project. A rush fee will be applied (and due) before the start of the project. I will determine the exact price of this fee when giving you a price quote if you express to me the urgency in having your project completed in a rushed time frame.

Hours of Operation
+ My general business hours are Mon – Fri, from 8AM – 8PM EST. Still, my availability varies. However, if you require work on the weekends (Saturday-Sunday), holidays or between the overnight hours of 8PM EST – 8AM EST on any weekday, you will be charged $50 per hour for “off hours” assistance. A one hour minimum is pushed for any “off hours” assistance. After the minimum time, fees are incremented in 30 minute intervals.

Additional Add-On Fees
+ Any add-ons and enhancements requested after design approval, the price will be negotiated.

Payment Methods
+ Payments are accepted via Square. Payment methods that are accepted are: Any US-issued and most internationally-issued cards bearing a Visa, MasterCard, American Express, Discover, JCB, or UnionPay logo. The following card types are accepted: Credit, Corporate, Debit (processed like credit), Prepaid & Rewards. If you prefer a different payment method (ie: Paypal, Cash App, etc.) please contact me.

Maintenance Fees
+ All maintenance fees vary upon the project, ranging between $25-$75/per hour, for web and graphic updates. A one hour minimum is pushed for all maintenance fees. After the minimum time, fees are incremented in 30 minute intervals.

Design Malfunction
+ I guarantee to you that every project I develop will be fully operational and working without glitches, bugs or other errors upon delivery. In the event that you receive your completed project and it is malfunctioned due to a mistake on my part, it will be fixed at no additional charge. If your project has been edited by anyone other than me (Digital Snack Bar), this guarantee is then voided, and charges for editing and/or fixing the malfunction will be applied at my hourly rate. So something goes wrong, due to client mishap, my hourly maintenance fee will be applied. This will be quoted to you individually depending on the job. I will always advise you of and seek permission for changes to your project and the charges that will be applied before any work is completed.

+ Digital Snack Bar is committed to provide you professional service, efficient communication, and product satisfaction. I want you to be 100% satisfied with your final product, and will work with you until you are 100% pleased. If you are in any way dissatisfied with the design of your project, I will make every possible effort to correct the situation to meet your expectations. My goal is to deliver the project as you envisioned it.

Acceptance
+ Please note that by submitting your deposit/payment for my services you are agreeing to all of the terms of service as written here. Digital Snack Bar reserves the right to change or update these terms at any time without prior notice.

*Until any and all payment for the project is received in full, all work done on the project is the property of Digital Snack Bar.
